Company: Broward Sunshine Property Services Inc. D.B.A Broward County Sod (“we,” “us,” “our”)
By accessing this website, placing an order, requesting a quote, or hiring Broward Sunshine Property Services Inc. D.B.A Broward County Sod for delivery or installation services, you (“Customer,” “you”) agree to be bound by the following Terms & Conditions. Please read them carefully before purchasing.
1. Living Product Disclaimer
All sod, plants, trees, and landscape materials sold by Broward Sunshine Property Services Inc. D.B.A Broward County Sod are living products. Natural variations in color, thickness, texture, and growth are normal and do not constitute defects.
Once sod is installed or accepted at delivery, environmental factors beyond our control, including weather, irrigation, soil conditions, pests, disease, foot traffic, fertilization practices, and maintenance routines directly affect performance and survival.
For this reason, no guarantees or warranties (express or implied) are offered beyond delivery condition unless explicitly stated in writing.
2. Orders & Payment Terms
• Full payment is required prior to delivery or installation unless otherwise agreed to in writing.
• We accept cash, approved electronic payments, and authorized online transactions.
• All prices are subject to change without notice due to market conditions, farm availability, and freight fluctuations.
• Any outstanding balances must be paid before materials are dispatched.
Failure to complete timely payment may result in order cancellation without liability.
3. Delivery Policy
• Delivery dates are scheduled based on farm harvest availability, weather conditions, traffic, and logistics.
• While we make every effort to honor scheduled dates, delivery times are approximate and not guaranteed.
• Customer is responsible for ensuring clear and safe delivery access (driveway, gate clearance, overhead clearance).
• Failed delivery due to access issues may result in redelivery fees.
Once sod is offloaded, title and responsibility transfer immediately to the customer.
4. Installation Services
If Broward Sunshine Property Services Inc.
D.B.A Broward County Sod performs installation:
• Customer must prepare irrigation, soil, grading, and access before arrival.
• Existing grass removal, soil amendments, regrading, or tree/root removal are not included unless quoted in writing.
• Customer is responsible for confirming sprinkler system functionality prior to install.
• Broward County Sod is not responsible for sod failure due to irrigation malfunction, inadequate coverage, or poor drainage.
5. Customer Responsibilities After Installation
The customer assumes full responsibility for:
• Proper watering schedule
• Mow height compliance
• Fertilization timing
• Pest and disease treatment
• Traffic protection during rooting
Failure to follow proper care standards voids all claims of workmanship or product condition.
6. Weather & Acts of God
We are not liable for delays or failures caused by:
• Heavy rain
• Flooding
• Freeze events
• Extreme heat
• Hurricanes
• Farm supply interruptions
Weather conditions may require rescheduling without refund or penalty liability.
7. Cancellations & Refunds
• Orders cancelled within 48 hours of scheduled delivery may be subject to cancellation and restocking fees.
• Once sod is harvested, no refunds are available.
• Installed sod is non-refundable under all circumstances.
• Deposits are non-refundable for same-week installs.
8. Property Damage & Utilities
Customer is responsible for:
• Marking all underground utilities (811 call required)
• Disclosing irrigation lines, septic systems, low-voltage wiring, and drains
• Ensuring property access is safe and unobstructed
Broward County Sod is not responsible for undisclosed underground damage.
9. Chargebacks & Payment Disputes
Any attempt to reverse payments after materials are delivered or work is completed will be treated as fraudulent misuse of services and may result in:
• Collections
• Legal enforcement
• Lien filing where permitted
• Recovery of attorney’s fees
10. Limitation of Liability
To the fullest extent permitted by Florida law:
Broward Sunshine Property Services Inc. D.B.A Broward County Sod total liability under any claim shall not exceed the amount paid by the customer for the specific service rendered.
We are not liable for consequential, incidental, indirect, or special damages, including loss of property value, aesthetic dissatisfaction, HOA penalties, lost rental income, or landscaping redesign costs.
11. No Guarantee of Growth or Performance
Growth performance varies by:
• Soil conditions
• Fertilization practices
• Irrigation consistency
• Shade cover
• Seasonal timing
No guarantees are made regarding exact rooting time, uniformity, or long-term appearance.
12. Website Use & Intellectual Property
All content on this website including text, images, logos, pricing structures, product descriptions, and marketing materials is the property of Broward Sunshine Property Services Inc. D.B.A Broward County Sod and may not be copied, scraped, or reused without written consent.
13. Governing Law
These Terms & Conditions shall be governed by and interpreted under the laws of the State of Florida. Any disputes shall be handled exclusively within Broward County, Florida.
14. Modifications to Terms
We reserve the right to modify these Terms & Conditions at any time without prior notice. Continued use of the website or services constitutes acceptance of updated terms.
